These terms govern your use of the Mālama Co website and the services we provide. By using our site or engaging us, you agree to these terms.
Our services
Mālama Co provides digital estate planning, organization, and preservation services. The specific scope, deliverables, and fees for any engagement are set out in a separate written agreement between you and Mālama Co.
Not legal advice
We are not a law firm. Information on this website and guidance provided during an engagement is not legal advice. We coordinate with your estate attorney so that your digital plan is properly referenced in your will under RUFADAA, but the legal documents themselves remain the responsibility of your attorney.
Your responsibilities
You agree to provide accurate information and to maintain control of your own credentials. You are responsible for the security of the password manager and accounts you own. We cannot recover accounts whose access is permanently lost by the platform itself.
Photos and digital assets
Photos, files, and other materials you provide remain yours. We do not claim ownership of your content. Your final library lives in storage you own and control — Mālama Co does not hold your memories hostage to a subscription.
Limitation of liability
To the fullest extent permitted by law, Mālama Co's total liability for any claim arising out of or relating to our services is limited to the fees paid to us for the engagement giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Changes
We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance.
